In these Terms of Use, “A-Write”, “we”, “us” and “our” refer to the owner and operator of this website and the educational services provided under the A-Write name. “You” and “Your” refer to all users and customers of the website and of A-Write services.
“The Website” refers to https://awritebook.com and any related sub-pages and booking pages controlled by A-Write. These Terms also apply, as relevant, to courses, events and services marketed through A-Write email, social media pages and online booking platforms.
By browsing, using or purchasing services through the Website, you agree to be bound by these Terms of Use, together with our Privacy Policy. If you disagree with any part of these Terms, you should not use the Website or purchase services. These Terms are not formal legal advice, but may be relied on in the event of a dispute.
1. General Use of the Website
- The content of the pages of the Website is for your general information and use only. It is subject to change without notice.
- Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
- Your use of any information or materials on the Website is entirely at your own risk, for which we shall not be liable. It is your responsibility to ensure that any products, services or information available through the Website meet your specific requirements.
- The Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, branding and graphics. Reproduction is prohibited other than in accordance with applicable copyright law and any licence terms set out on the Website.
- All trade marks reproduced in the Website which are not the property of, or licensed to, the operator are acknowledged on the Website where reasonably possible.
- Unauthorised use of the Website may give rise to a claim for damages and/or be a criminal offence.
- From time to time, the Website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse such websites. We have no responsibility for the content or practices of linked websites.
2. Submissions, Copyright and Ideas
- All rights to creative work submitted by you (including manuscripts, extracts, scripts, poems, essays and other material) remain with you as the copyright owner, unless explicitly agreed otherwise in writing.
- All submissions are made at your own risk. While we will treat your work with professional care, A-Write cannot accept responsibility for any future perceived duplication of ideas. It is possible that A-Write staff or associates may be working on similar ideas independently before, during or after your submission.
- If a dispute arises regarding originality or duplication of ideas, the parties may refer the matter to legal counsel, where the dispute will be decided by independent judiciary in the Republic of Ireland.
3. Payments, Bookings and General Refunds
- Unless otherwise noted, payments for A-Write courses, events and services are made in advance via the payment methods indicated (for example Square, bank transfer or other platforms).
- Course fees and prices may change from time to time based on market conditions, costs and other factors. Changes will not affect bookings already confirmed and paid.
- If a course or event is sold out and you book using a link that has not yet been updated, we will offer you the next available start date, course credit of equal value, or an alternative service. Monetary refunds are normally not offered in this situation except in grievous circumstances.
- A-Write reserves the right to provide refunds in the form of course vouchers, gift cards, deferrals or services of equal value, rather than cash, except where a monetary refund is required by law or explicitly stated in a specific offer.
- These Terms of Use do not affect your statutory rights under the laws of the Republic of Ireland.
4. Online Courses, Video Conference (VC) & Remote Services
Many A-Write courses and consultations are delivered online via Zoom or similar video-conference (VC) platforms. The security, peace of mind and enjoyment of participants are of paramount importance.
- By attending any A-Write course, workshop, mentorship or consult via VC, you agree to abide by these Terms and any reasonable instructions from the facilitator.
- File-sharing and screen-sharing functions may be disabled for participants on A-Write sessions to protect security and privacy.
- No unauthorised recording (audio or video), screen-shots or photography of any A-Write session are permitted.
- No non-participating persons may attend or be present with you during an A-Write session, unless explicitly agreed in advance.
- Participants are requested not to use other devices during sessions (except where a phone is used for audio) and to minimise background noise. The facilitator may mute participants to reduce disruption.
- Under-18s are not permitted to attend A-Write courses or be present in the room during VC sessions.
- Every reasonable effort is made to prevent unauthorised access to VC sessions. However, if any person gains access and disrupts or alters security settings, A-Write accepts no liability for any perceived or actual loss, distress, theft, duplication or publication of content arising from such unauthorised access.
- All creative material shared by participants during a course remains the property of the participant. No other participant may reproduce or publish such material outside the course parameters without explicit permission.
- Access codes for VC sessions are for your personal use and must not be shared online or in any other way.
- Teaching materials provided during a course are for your personal use and must not be shared or republished without written permission, except in the case of explicitly educational/academic use where clear attribution to A-Write is included.
- If you attend a course via VC in a public place, you must use headphones.
5. In-Person Courses, Events and Conferences
From time to time A-Write (or associated brands) may run in-person courses, seminars or conferences (“Events”) at hotels, venues or other locations (“Hotels”). The following applies to all such Events, in addition to the rest of these Terms.
- A registration item (for example “Admission”, “Package” or similar) grants access to the Events and benefits as clearly outlined in the brochure, booking page or email at the time of purchase. Unless explicitly stated, accommodation and meals are not included.
- Any accommodation included in a package is subject to the Hotel’s own terms and conditions. A-Write is not responsible for any incident, loss, disturbance, illness or accident arising from Hotel services, travel or any other matter beyond the educational content of the Event.
- Group bookings and variations (for example partial attendance, sharing rooms, non-attending partners) are arranged on a case-by-case basis and confirmed via email.
- The Event schedule (“Schedule”) is subject to amendment at any time, for example due to speaker cancellations, illness, technical issues or market conditions. We will give reasonable notice and will endeavour to replace any cancelled event with a similar one or an alternative of equal value (such as a later event, online event or course credit).
- If an Event is cancelled for reasons within A-Write’s control, you will be offered a 100% refund of the Event registration fee, or the option to transfer to a later date, or convert your payment into course/service credit (which may be of higher value than the original fee, as specified at the time).
- If an Event is cancelled due to circumstances beyond A-Write’s control (force majeure), you will be offered options such as a refund less handling costs, course credit, transfer to a later date and/or an online alternative, as outlined at the time. In all cases, A-Write is not liable for external costs such as travel or accommodation booked directly with third parties.
- We may photograph or film parts of Events for marketing purposes. If you do not wish to appear in such material, please let us know on registration or at the Event and we will respect your wishes.
6. Rescheduling, Low Registrations & “Under Quota” Courses
- A-Write may postpone or reschedule a course or event if registrations are below the minimum required to run the course (“under quota”), or for other reasonable operational reasons.
- In such cases you will be offered: (a) a later start date for the same course; (b) an equivalent online version; (c) a one-to-one mentorship or editorial service of similar value; or (d) course credit to use on any other A-Write or MKCW service within 12 months.
- Monetary refunds are normally only provided where no reasonable alternative can be offered, or in grievous circumstances, or where required by law.
- If you do not wish to use online technology, we will endeavour to provide an in-person alternative of equal value within 12 months. If this is not possible and you request a monetary refund in writing, A-Write will arrange a refund and may, in the event of adverse economic conditions, process it within up to 12 months of the request.
- A-Write reserves the right to amend course content in response to the consensual wishes of a class, provided that each participant receives access to the modules relevant to their interests either live or online.
- A-Write reserves the right to change the tutor delivering a course at any time. Courses will be delivered by Dr Martin Keaveney or a similarly qualified associate lecturer unless otherwise noted.
7. Specific Refund & Transfer Rules
- Unless otherwise specified in the course description, fees for A-Write courses and events are non-refundable. If you cannot attend for any reason, you will normally be entitled to attend a future course or event of equal value within 12 months of the original date, or to transfer your credit to another service.
- If a course is marked “sold out” and you book using an outdated link, we will offer the next available start date, credit for any other service of equal value, or a place on a similar course.
- Gift cards and course credits may be used against any current A-Write or MKCW course listed on the relevant website. They are normally valid for 12 months from purchase; extensions may be granted on request but may be subject to price adjustments.
- A-Write reserves the right not to provide further services to customers who have previously received full refunds, except at its discretion.
8. Teaching Staff
- Courses and services are delivered by Dr Martin Keaveney or by suitably qualified associate lecturers, writers and professionals appointed by A-Write.
- The specific tutor for each course may change and will be communicated in the course description or by email where relevant.
9. Governing Law & Changes to These Terms
- Your use of the Website and any dispute arising out of such use is subject to the laws of the Republic of Ireland. Any legal proceedings shall be brought in the Irish courts.
- A-Write may update these Terms of Use from time to time. The most recent amendment date will appear at the top of this page. Where practicable, we will highlight material changes on the Website.
- If there is any conflict between earlier versions of these Terms and later versions, the most recent version shall prevail.
